Welcome to TeMed.com (the "Site"). TeMed.com is a product of, and is provided to you by TeMed Holdings ("TeMed"). PLEASE READ THIS PRIVACY POLICY AND INFORMED CONSENT ("Privacy Policy") AS WELL AS THE TERMS OF USE FOUND ON THE SITE. YOU ARE REQUIRED TO AGREE TO THE TERMS OF USE AND PRIVACY POLICY BEFORE USING TEMED OR ITS SERVICES.

Informed Consent to the Use of Telemedicine

Telemedicine involves the use of electronic communications to enable physicians and patients to share patient medical information for the purpose of improving patient care.

As with any medical procedure, there are potential risks associated with the use of telemedicine. These risks include, but may not be limited to (i) remote consultations cannot replace emergency services. If your conditions are distressful, urgent, or life threatening, please got to the nearest emergency room immediately; (ii) physicians using the TeMed website will provide you with clinical assessments and recommendations based on all of the information you provided online. There are no physical exams involved, which is an essential part of clinical consultation. Therefore, the physician’s statements from online TeMed consultation cannot be always correct and sometimes may be wrong. To avoid this deficiency, you may need to visit the physician in his or her office; (iii) in some cases, the transmitted information is of inadequate quality, thus necessitating a face-to-face meeting with the patient, or at least a rescheduled video consult; (iv) in very rare instances, a breach of privacy of medical information may occur, and (v) in rare cases, a lack of access to complete medical records may result in unforeseen medical complications or other judgment errors.

    I understand that the laws that protect privacy and the confidentiality of medical information also apply to telemedicine, and that no information obtained in the use of telemedicine, which identifies me, will be disclosed to researchers or other entities without my written consent.

    I understand that I have the right to withhold or withdraw my consent to the use of telemedicine in the course of my care at any time, without affecting my right to future care or treatment.

    I understand that telemedicine may involve electronic communication of my personal medical information to medical practitioners who may be located in other areas, including out of state. I have read and understand the information provided above regarding telemedicine.

    I have discussed it with my physicians or such assistants, all of my questions have been answered to my satisfaction, and I hereby give my informed consent to participate in a telemedicine visit provided by TeMed under the terms described herein.

Use and Acceptance

TeMed provides you with access to the Site, and the services provided though the Site (the "Services"). By entering and using the Site, you signify your acceptance of this Privacy Policy and to the terms described herein. If you do not agree with this Privacy Policy, you may not enter, access, or otherwise use this Site. TeMed reserves the right to modify the Privacy Policy periodically, for any reason, and without notice. It is recommended that you read this Privacy Policy before use of the Site to ensure you have not missed any changes to the Privacy Policy. Your continued use of the Site following any changes to the Privacy Policy signifies your acceptance of those changes. TeMed has the right to limit, suspend, discontinue or deny your access and use of the Services at any time, and without notice, to anyone who violates these Terms as TeMed considers appropriate or necessary in its sole discretion.

Information That May Be Collected

The first time you log in to the Site to utilize the Services, you will be asked to create an account also known as your profile. To create an account, you must provide personal information such as name, date of birth, e-mail address, gender, and telephone number that will be available for you to share with the participating provider.

TeMed will use the e-mail address and details you provide to create a username and temporary password and will send you an e-mail requesting that you validate your account. Your e-mail address may also be used by TeMed to provide appointment reminders, changes in appointments, or messages from your physician. TeMed will use your e-mail address as the primary means to reset your username and password. Your e-mail address will not be shared with any other third parties and will not be used for advertising or sales purposes.

TeMed creates a record of the care and services you receive. Some examples of the information collected or created through this process are video and/or audio files associated with all consultations, electronic medical records that may be uploaded or created as a result of treatment, and medical test results.

For certain services, such as for subscription, health sessions and monitoring services, we will collect credit card or billing/payment account information which we maintain in encrypted form on secure servers.

In order to participate in the Services, you will need to provide Personal Health Information ("PHI") about yourself to either TeMed or the participating physician. Here are examples of the types of PHI we gather:

Information You Give Us - Examples of the types of information you may provide us include measurements, such as weight, blood pressure or glucose levels, lab results, medications, health history, and other health or PHI, such as prescription information.

Information Accessed through Third-Party Data Services - When you use our Services, we may access health-related information about you that is stored with third party-data services such as Microsoft HealthVault or Google Health, and such information will subsequently be available to us.

Third-Party Information - Health-related information about you received from third-parties (such as nurses, doctors or family members) as well as personally identifiable and other health-related information you provide specifically related to family members who may be utilizing the Services under your account.

Demographic Information, such as age, education, gender, Social Security Number and Zip Code.

NOTICE OF HIPAA PRIVACY PRACTICES

TeMed respects the privacy of its Site users and is committed to protecting PHI. The creation, use, disclosure, and safeguarding of PHI communicated electronically is primarily governed by the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and the Health Information Technology for Economic and Clinical Health Act ("HITECH"). TeMed employs a variety of procedural, structural, and technological safeguards to assure that any PHI communicated thought the Site is used and disclosed in conformity with HIPAA and HITECH. TeMed may only use the information you provide through this Site for purposes permitted or required by law, as described in this Privacy Policy.

This Privacy Policy applies only to how TeMed uses PHI that you provide when visiting the Site. PHI that you provide through this Site or that TeMed creates or receives may be used or disclosed by TeMed in connection with services provided by TeMed, including, but not limited to treatment, payment and health care operations, and for other purposes that are permitted or required by law. TeMed regularly gathers quantitative information on website activity, including the number of users to this Site and the pages visited, but this is de-identified information and does not constitute PHI. TeMed is not responsible for any PHI that is directed by a registered user, to be transmitted or transferred, once the PHI leaves the site.

As used in this HIPAA Privacy Statement, "required by law" includes the permissive and mandatory requirements of state and federal regulations that govern the use and disclosure of individually identifiable information, such as the federal regulation known as the HIPAA Privacy Rule.

To perform these functions or to provide services, business associates will receive, create, maintain, use, or disclose protected health information, but only after we require the business associates to agree in writing to contract terms designed to safeguard your information.

    TeMed is also permitted to use and disclose PHI to support the services TeMed provides through this Site, and to support the business functions provided by TeMed.

    TeMed may use or disclose PHI obtained through this Site to assist our business associates or other covered entities in their treatment, payment, or health care operation activities. TeMed may use your PHI (including online personal information) to create aggregated anonymous information for the purposes of tailoring our Site to meet our customers’ needs and interests. Distribution and use of this aggregated, anonymous information will be restricted to staff, management, agents, and business associates of TeMed who need aggregated statistical information about our users as a group, as well as the patterns of their Site usage.

    TeMed reserves the right to perform statistical analyses of user behavior on an aggregate basis to measure interest in, and use of, the various areas of the Site, and to inform agents/business associates, affiliated companies, or any others permitted by law to receive such information.

    TeMed uses Secure Socket Layer ("SSL") encryption technology to enhance data HIPAA Privacy and help prevent loss, misuse, or alteration of the information under our control. This encryption technology, however, does not absolutely guarantee or safeguard the total HIPAA Privacy of user information that has been voluntarily disclosed to the Site. Once your information leaves our Site, TeMed is no longer able to control further disclosure of your information. If you choose to share your PHI over email, you acknowledge the risk of unsecured communication.

    TeMed uses a standard technology called a "session cookie" to enable our website to recognize you during a visit to this TeMed Site. The session cookie is stored in temporary memory on your computer and is not retained after you close your browser.
